TERMS AND CONDITIONS OF USE
By accepting this agreement, the City of Port Phillip grants to you a personal, non-exclusive and non-transferable licence to use the service, subject to these terms and conditions of use.
You acknowledge that the City of Port Phillip may vary or update these terms and conditions at any time by placing a notice on this website. In addition, whenever using this service, you may be subject to any relevant guidelines or rules which the CoPP may cause to be posted on this website from time to time.
1. Eligibility
a. Public Access:
Permission to use and access the service is conditionally provided to all individuals, companies and organisations
Public access does not require any user validation
Private Access - Permission to view or maintain personal, non-public information via the service is restricted to registered users
The CoPP reserves the right to alter, limit or withdraw access to any service(s) at its discretion
Access to the service is not limited by geographical location
b. Private Access Registration:
Registration is open to all individuals, registered companies or organisations
Access to any service/s that allows for the viewing, maintenance, creation or tracking of personal transactions or information specifically related to the user requires the user to be registered
The CoPP reserves the right to decline any request for user registration
User registration may be revoked or deactivated by the CoPP at any time without prior notice to the user and in accordance with section 3 of this document
Companies or organisations requesting registration must provide a valid ACN /ABN or other appropriate information as requested by the CoPP
The user is responsible for the security or their username and password. The CoPP does not accept any responsibility for the improper use of login details
User registrations are processed in accordance with Councils Online Services User Validation and Registration Protocols
2. Revocation of Service
Access to Online Services may be limited or withdrawn due, but not limited to:
a. Improper Use
Improper use of the service shall be deemed to include, but is not limited to:
Uploading defamatory or libellous material
Use of expletives or other language that is deemed offensive.
Use specifically designed to adversely affect the speed and efficiency of the service
Unauthorised use of another users logon details
b. Vexatious Use
Vexatious use of the service shall be deemed to include, but is not limited to;
Repeated initiation of blank or illegible transactions
Purposeful repetition of the same transaction where no technical issue is apparent or where repetition is designed to limit the performance of the service or affect other users access to the service
c. Payment Defaults
User accounts may be suspended as per the conditions of section 4a
3. Payments and Fees
a. Dishonoured Fees
Where payment is required and has been dishonoured for two or more separate transactions, CoPP will suspend a registered user's access to the associated transaction type/s until such time as all amounts in arrears have been finalised
Refer to the Council Plan and Budget for the current dishonour fee.
Settlement of dishonoured payments will be accepted in the form of cash or bank cheque only
The CoPP may also request payment of any miscellaneous administration fees charged by banking institutions, in the event of a dishonoured payment
b. Fee Schedule
All fees are GST inclusive unless otherwise indicated
Fees will be charged as per the current fee schedule(s) which may be found on the following pages

The CoPP reserves the right to review and amend fees at any time in accordance with the relevant council policy or bylaw that governs the fee or charge
c. Refunds
Requests for refund due to special circumstances will be considered on a case-by-case basis
The CoPP accepts no responsibility for duplicate processing of payments due to user error
For security reasons, any refunded amounts will be returned by cheque in the name of the originator of the transaction only
d. Accepted Method of Payment
As at 1 March 2006 CoPP will only accept credit card payments
The CoPP currently accepts Visa Card, MasterCard and Bankcard
American Express and Diners Club are not accepted at this time
4. Technical Requirements
a. Platform and Browser
Service is optimised for use with Microsoft Internet Explorer v5.5 or higher operating in a Windows environment. The service is not currently supported in a Macintosh environment
CoPP does not guarantee the available or reliability of the service where it is not accessed via Microsoft Internet Explorer
b. Accessibility
The system currently does not support screen reader software.
The CoPP is currently working with its software providers to deliver this functionality in line with its Disability Action Plan.
c. Availability of service
Online Services relies on the Internet.
Access to the Internet by users of this service is dependent on numerous factors, technologies and systems, many of which are beyond the CoPP's authority and control
The CoPP will not be liable or responsible for your ability or inability to access the Internet
The user is solely responsible for obtaining access to the Internet
CoPP reserves the right at any time and from time to time to modify, suspend or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice to you.
CoPP will not be liable to you or any other third party for any modification, suspension or discontinuance of the service
The CoPP endeavours to make Online Services available at all times but accepts no responsible for technical, seasonal or other factors that limit the availability of the service
The CoPP will alert users to system maintenance operations as early as practicable
5. Support
Customer support is available for this service during business hours. (8.00am to 5.30pm, Monday to Friday)

When requesting customer support, users are asked to provide as many details as possible about their issue, including any error messages received
6. Indemnity
You agree to indemnify and hold harmless the CoPP and its employees and agents from and against any loss (including reasonable legal costs and expenses) or liability incurred or suffered by any of them arising from any proceeding against them where such loss was caused by any of the following:
A breach by you of your obligations under these terms and conditions; or
Any wilful, unlawful, or negligent act or omission by you
7. Your obligations and responsibilities
You are responsible for providing accurate information (including but not limited to your real name, address and details of the relevant property) to the CoPP
You must not:
Allow any unauthorised person to use this service; or
Access this service through any illegal or unauthorised means; or
Use this service in any manner which is harmful to, or detrimental to users, CoPP, or any other person
You warrant that in accessing and using the service you will only use software that you are legally entitled to use
You must notify CoPP immediately if you become aware of any unauthorised access or use of the service, or any other breach of security in relation to the service
You will be solely responsible for any damage to your computer system or any other computer system you use to access the service or for any loss of any data resulting from any material you have downloaded or otherwise obtained through the use of the service
8. Copyright
Any copyright material on this website or the service is owned by the CoPP and/or other copyright owners.
Apart from fair dealing for the purposes of your personal use of the service in accordance with these terms and conditions, you may not reproduce, distribute, adapt, transmit, store, or reuse any part of this website or the service without prior written permission from the CoPP.
9. Privacy
The CoPP is committed to protecting personal information it collects by complying with the Information Privacy Act 2000
The CoPP and/or people authorised by it may gather and process personal information provided by you (such as your name, address, and email address) through online forms and e-mails you submit via this service.
Your personal information provided in this way will only be used and disclosed for the purpose for which you provided the information, in accordance with your consent or where otherwise permitted, authorised or required by law
The CoPP and/or people authorised by it may also gather and process information regarding the way in which you use the service and this website
You acknowledge that the CoPP has implemented security measures to protect the personal information collected through the service. However, you acknowledge that there are risks in transmitting information on the internet, and the CoPP cannot ensure or warrant the security of any information transmitted to the CoPP through this service.
You agree that you transmit information to the CoPP at your own risk
